THE LAKE
- Usage: Whisper Lake is our community's most valuable asset. It is a private lake, meant only for lot owners and residents in good standing (current with their dues) and their guests.
- Use the lake at your own risk! There are no lifeguards.
- To help ensure the lake is used by members only, a Whisper Lake decal should be displayed on your car windshield or golf cart. Decals are available at POA support, our management company. Each numbered decal is assigned to a specific homeowner and is not transferable. Full time renters should obtain a decal from their property owner landlord. Owner landlords may arrange for short term renters to receive a Whisper Lake Guest Pass. If not recognized by other residents or security, lake users may be asked to show proof of ownership.
- Please do your part to keep the area clean and tidy.
- Guest Policy:
- Residents cannot invite workmen or friends outside of Whisper Lake to use the Lake “under their name”.
- Guests must either be accompanied by the homeowner or have a current Guest Pass issued by POA Support, our management company.
- Water Craft Usage:
- With the exception of the company that treats the lake and small, electric-motor powered craft, no internal combustion engine -powered craft are allowed on Whisper Lake.
- All water craft that utilize Whisper Lake must be registered with our Management Company and have a registration sticker affixed to the craft.
- Storage space for watercraft is extremely limited and in high demand. If you have a water craft stored at the dock area and are no longer using it or move away from Whisper Lake, please contact our Management Company or any member of the Board and remove your craft from the area.
- Due to the severe shortage of storage space, each lot owner will be allowed only one storage space. If more space is needed, when space is available, an additional space may be obtained by payment of an annual fee. The additional storage space fee will be determined annually, by the Board of Directors. Initially, the charge will be $50.00. Funds received for additional storage will be used to enhance and maintain the dock area. Current owners of more than one water craft will be Grandfathered in.
- Each watercraft stored in the dock area will be assigned an individual storage space. When not in use, each craft must be stored in its’ assigned berth. It is up to each individual owner to ensure their watercraft is properly stored in its’ designated storage berth. Failure to do so will result in the loss of storage space and the removal of your craft. Initially, storage spaces will be assigned to all registered water craft. Subsequently, they will be assigned by POA Support, our management company.
- Due to size, weight and handling issues, storage of Jon boats and pedal boats at the dock area is discouraged. Current owners of registered boats will be grandfathered in. But no additional Jon boats or pedal boats may be stored at the dock site.
- With the exception of those craft grandfathered in, no craft will be stored on the ground. No water craft will be chained to trees.
- POA Support, our Management Company will maintain a list of all registered water craft and their assigned storage spaces as well as a waiting list for those who want a storage space or additional space. After the initial assignment, Storage spaces will be issued on a first come first served basis from the waiting list.
- In the future, owners who would like to store their craft near the dock, must request and be assigned a specific storage space for their craft by POA Support. The Storage Space number must be affixed and clearly visible, on all watercraft.
- Please do your Part in keeping the dock area neat and orderly and return your watercraft to its’ designated storage spot at the end of each day or take it home with you.
FISHING
Whisper Lake stocks the lake with bluegill, bream, and largemouth bass for the fishing pleasure of our residents. Catch-and-release rules are in effect
SWIMMING
Swimming and use of the dock area is at your own risk. Whisper Lake provides no lifeguard and assumes no responsibility for your safety.
CLEANUP
Please use the trash receptacles provided or take your trash home with you. Please clean up after your pets. We all need to do our part to keep the area clean and tidy for the benefit of all residents.
ANIMALS
Our Declaration of Restrictive Covenants specifies that no animals shall be kept or maintained except the usual household pets, which shall be kept on a leash or controlled outside the owner’s property.
- Nuisance is defined as habitual barking or howling. It is also defined as destroying property and running at large.
- Any animal that has bitten or threatened to attack a human or another animal is deemed to be a danger.
Owners must confine their pets to their property or control them on a lease when in common areas so as not to cause a nuisance or danger.
- The owner of a pet that is a nuisance will be informed, in writing, when a complaint is made and Blue Ridge Public Safety will be notified.
- The owner of a pet that is deemed to be a danger will be reported immediately to Blue Ridge Public Safety and Jackson or Transylvania County Animal Control. Owners will be informed immediately, in writing, when a complaint is made.
RECREATIONAL VEHICLES
No recreational vehicles, motor homes, or camping trailers may be parked overnight on Common Areas including but not limited to parking areas, streets, or vacant lots.
TRASH PICK UP
Residents should not leave their household trash curbside, which is a Common Area. All trash companies that service Whisper Lake will pick up trash from their customers’ garages, front doors, or porches. Residents should inform their company of the pick-up location. Eliminating curbside trash will add to our appearance of cleanliness and reduce the number of animal scavengers.
FIRES AND COOKOUTS
As a safety precaution against wild fires; leaf burning, campfires and cookouts are not allowed on Whisper Lake Common Areas.
FIREWORKS
North Carolina has a very strict fireworks law. The North Carolina zero tolerance law bans the possession, sale, and use of any pyrotechnic intended to detonate or explode, spin, or propel itself into the air. By definition, this ban includes fire crackers, ground spinners, Roman candles, bottle rockets, and mortars. Essentially, any firework that leaves the ground is not legal in this state and therefore not allowed on Common Areas in Whisper Lake.
